La expulsión penal de personas extranjeras: una paradoja jurídica entre el Derecho administrativo sancionador y el Derecho penal

Abstract

El artículo analiza la expulsión penal de personas extranjeras, destacándola como una figura jurídica problemática, especialmente en lo relativo a su naturaleza jurídica. Originalmente concebida como una medida administrativa, su incorporación al ámbito penal ha generado tensiones al contravenir principios fundamentales del Derecho penal. Además, se cuestiona su instrumentalización para objetivos de política migratoria y control fronterizo, lo que ha dado lugar a un régimen desigual que refuerza estereotipos negativos sobre la inmigración y las personas extranjeras. En este contexto, se plantea la necesidad de eliminar esta figura del Código Penal, considerando su falta de justificación sólida y su impacto en los derechos humanos de las personas migrantes. ---------------------------------------------------------------------------------------------------------

The article analyses the criminal expulsion of foreigners, highlighting it as a problematic legal concept, especially regarding its legal nature. Originally conceived as an administrative measure, its incorporation into the criminal sphere has generated tensions by contravening fundamental principles of criminal law. Its instrumentalisation for migration policy and border control purposes is also questioned, which has given rise to an unequal regime that reinforces negative stereotypes about immigration and foreigners. In this context, the need to eliminate this figure from the Criminal Code is raised, considering its lack of solid justification and its impact on the human rights of migrants.
