Derechos Humanos y medio ambiente en el Tribunal europeo de Derechos Humanos: Breves notas para el futuro contexto internacional

Abstract

El artículo examina el proceso evolutivo seguido por la jurisprudencia del Tribunal Europeo de Derechos Humanos en materia de medio ambiente. A través de ese análisis se observa la creciente importancia que la temática ambiental va adquiriendo en la jurisprudencia del Tribunal Europeo de Derechos Humanos, hasta el punto de que, gracias a la misma, ha habido varios intentos de elaborar un protocolo adicional al Convenio Europeo de Derechos Humanos incorporando al mismo el derecho al medio ambiente. Esa tendencia es expansiva y de alguna forma se está empezando a vislumbrar igualmente en instituciones como Naciones Unidas. Todo lo cual permite colegir las interesantes posibilidades de futuro que se perfilan en la materia, especialmente a nivel de organizaciones internacionales. ---------------------------------------------------------------------------------------------------------

This article analyses the evolution of the court decisions elaborated by the European Court of Human Rights regarding the protection of the environment. Through this analysis it can easily be observed the growing relevance that the protection of the environment has for the European Court of Human Rights. As a result, there have been several attempts to create an additional protocol to the European Convention of Human Rights dealing with the protection of environment. This expansive trend can also be observed within other international organisations such as United Nations. Accordingly, it goes without saying that the future perspectives of the subject into the international arena are of great importance.
