Abstract

El artículo analiza los problemas que presentan los cambios jurisprudenciales desfavorables al reo. A tal efecto, se estudia la llamada “doctrina Parot”, que ha motivado la condena a España por el Tribunal Europeo de Derechos Humanos (STEDH Del Río Prada contra España, 2012). En el trabajo se defiende la ilegitimidad constitucional de la aplicación retroactiva de los cambios jurisprudenciales desfavorables al reo por ser contrarios al principio de legalidad en sentido material. ---------------------------------------------------------------------------------------------------------
This article analyses the problems which presented the jurisprudential changes unfavorable to the accused. To this end, we study the “Parot doctrine” which has led to the condemnation of Spain by the European Court of Human Rights (SECHR Del Rio Prada against Spain, 2012).The paper defends the constitutional illegitimacy of the retroactive application of jurisprudential changes unfavorable to the accused as being contrary to the principle of legality in the material sense.
