Agresión y victimización en la violencia de género ¿Defensa legítima o venganza?

Abstract

Es obvio que la víctima del delito ya no se resigna a ser sujeto pasivo de la acción antijurídica, y quedar preterida de la respuesta penal a la agresión sufrida, salvo la facultad procesal de la acusación particular. La actividad jurídica procesal de la víctima no siempre tiene la suficiente relevancia como para restaurar la humillación y las lesiones sufridas. En una agresión mantenida en el tiempo es entendible una respuesta más inmediata y efectiva, si ello fuera posible. Y en la dinámica acción-reacción suele surgir la controversia de la legalidad de la respuesta. La legítima defensa, su estricta regulación normativa y su variada aplicación —comprensible por la abundante casuística— no siempre es acogida en la jurisprudencia con igual comprensión

The victim of the crime, obviusly, is no longer resigned to being a passive subject of the unlawful action, and to be excluded from the criminal response to the aggression suffered, except for the proce-dural power of the private prosecution. The procedural legal activity of the victim is not always relevant enough to restore the humiliation and injuries suffered. In an aggression maintained for a long time, a more immediate and effective response is understandable, if possible. And in the action-reaction dynamic, the controversy of the legality of the response usually arises.
