Abstract
Los delitos de tráfico de drogas son una de las manifestaciones más evidentes del llamado
“Derecho penal del enemigo”, caracterizado por una quiebra de los principios penales básicos, que no
ha compensado desde ninguna perspectiva. Con frecuencia, el asunto de la degradación de los derechos y
garantías de los ciudadanos se plantea como una cuestión exclusivamente, o casi exclusivamente, legisla

tiva, sin advertir el relevante papel que los aplicadores del Derecho, y en particular los jueces y tribunales,
desempeñan y pueden desempeñar en este ámbito, con su connivencia o con su resistencia. Se seleccionan,
de entre la multitud de resoluciones de la jurisprudencia española sobre el tráfico de drogas, algunos ejem

plos del importante papel que a estos efectos puede desempeñar los jueces y tribunales.
