El sentido de la complicidad. Una visión crítica de las llamadas acciones neutrales como grupo de casos de la teoría de la imputación objetiva

Abstract

Tomando como punto de partida la teoría de la acción significativa, se analiza la problemática de las acciones neutrales en el marco de la imputación objetiva. El debate que se ha reabierto en Alemania se considera nocivo, pues lo relevante de la responsabilidad del partícipe no depende de la asunción de un riesgo en el marco de la imputación objetiva, sino del sentido subjetivo de la adhesión del partícipe al delito del autor.

Starting from the Significant Action Theory, this paper analyzes the neutral actions predicament within the framework of the objective allocation. The discussion reopened in Germany is a harmful one because the relevance of the participator responsibility is not depending on the risk assumption within the framework of the objective allocation, but the subjective sense of the participator adherence at the crime of the perpetrator.
