abstract = {La reforma del Código penal realizada por la LO 5/2010, de 22 de junio ha afectado de manera sustancial y directa a la regulación del terrorismo y de los delitos terroristas. Una de las principales y más importantes novedades radica en la incorporación de un concepto de organizaciones y grupos terroristas que contiene los elementos que tradicionalmente se habían identificado por la doctrina y la jurisprudencia Por otro lado, el cambio radical que supone pasar de un terrorismo nacional o sectorial a un terrorismo religioso, fundamentalista y global, nos obliga a efectuar una análisis de las notas esenciales del mismo a fin de determinar su adecuación o no al concepto y elementos incluidos en el Código penal.
