AB Ante las dificultades que afrontan las concepciones garantistas del Derecho penal, debidas especialmente,en la actualidad, al «populismo punitivo» y a los discursos del Derecho penal del enemigo y de la «modernización» del Derecho penal, se explica hasta que punto éstos pueden resultar o no novedosos frente a la realidad latinoamericana,y a la colombiana en particular. AB In view of the difficulties faced by a point of view «garantista» of the criminal law, nowadays speciallydue to the «punitive populism» and the discourses of the «criminal law of enemy» and the «modernization» of thecriminal law, in this work is explained whether they do or not innovate facing Latino-American reality and Colombianreality in particular. This paper also reply to the critics that the discussion about the modernization of criminallaw present to the «garantismo»
