AB El Reglamento «Roma I» sobre la ley aplicable a las obligaciones contractuales ha introducidomodifi caciones sustanciales relevantes con respecto a su antecesor: el Convenio de Roma. Algunasde las novedades del Reglamento «Roma I» afectan al régimen general de determinación de la lexcontractus, dentro del cual queda encuadrado uno de los contratos más habituales en la práctica comercialinternacional de nuestros días: el contrato internacional de agencia comercial. El presente estudioanaliza el impacto de las modifi caciones incorporadas por el Reglamento «Roma I» en la problemáticarelativa a la ley aplicable a los contratos internacionales de agencia comercial «intracomunitarios» y«extracomunitario». Detrás del problema objeto de estudio subyace, como telón de fondo, la necesidadde alcanzar una coherencia valorativa o armonía en el seno del ordenamiento jurídico comunitario.
AB The Rome I Regulation on the law applicable to contractual obligations has introducednew and substantial changes with respect to the previous law: The Rome Agreement. Some of the newaspects of the Rome I Regulation affect the general regimen of the lex contractus resolution, whichincludes one of the most common agreements in the current international and commercial practice: theinternational commercial agency agreement. This study analyzes the impact of the modifi cations in theRome I Regulation, particularly the thorny issue of the law applicable to the international commercialagency agreements, be they «EC contracts» or «non-EC contracts». The crux of the matter is the need toproduce coherent, harmonious Community law on the subject..
