T1 EEES, competencias y aprendizaje del derecho romano mediante el método del caso (I) : prisionero de guerra

AB Con la realización del presente trabajo pretendemos investigar sobre laimportancia actual de aplicar el método del caso en la enseñanza del Derecho Romano,frente a las tradicionales clases teóricas y magistrales. Reparando, muy especialmente,en el alcance de las exigencias metodológicas surgidas con los nuevos planes delestudio Grado en Derecho en el marco del EEES; así como en el desarrollo de una seriede competencias generales y específicas en los estudiantes, que les van a ser muy útilesuna vez que finalicen el Grado y se enfrenten a las dificultades del mercado actual, yaque se consideran como los verdaderos protagonistas del proceso de enseñanzaaprendizaje.Por tanto, con la puesta en práctica de este primer caso sobre doblematrimonio romano, ausencia de testamento y herederos legítimos, intentamos acercaral alumnado al casuismo jurisprudencial romano; de este modo, comprenderán que loimportante no es dar la solución al supuesto planteado, sino razonar jurídicamenteconsiguiendo, a través de debates en grupos, un conocimiento más profundo de lasreglas e instituciones aplicables.
AB With the accomplishment of the writing that follow we pretend to investigatewhat the current importance of applying the case method in the teaching of Roman Law,against the traditional theoretical and magistral classes. Repairing, especially, in thereach of the methodological requirements emerged with the new plans of study LawDegree under the EEES; as well, in the development of a set of general and specificskills in students, that will be very helpful once time they finish the Degree and face thedifficulties of today's labor market, because they are the true protagonists of theteaching and learning process. Therefore, with the implementation of this first case ondouble roman marriage, lack of testament and legitimate heirs, we try to approach thestudents to casuism roman jurisprudence; in this way, they will understand that theimportant thing is not to give the solution to case proposed but legal reasoning, throughdiscussions in groups, getting a deeper knowledge of applicable rules and institutions.
