abstract = {A partir de los discursos narrativos de la prensa en un caso concreto, se analizan las tensiones entre el derecho a informar y ser informado, por una parte, y el respeto de las garantías penales y derechos fundamentales de los implicados en el proceso penal, por otra parte. Cuestiones como el secreto del sumario, el respeto a la dimensión extraprocesal de la presunción de inocencia, la salvaguarda de los derechos al honor, intimidad y propia imagen de los participantes en el proceso penal son confrontados con la libertad de información de los mass media. Para ello, se expone el estado de la cuestión a nivel legislativo, jurisprudencial y deontológico, con el objetivo de realizar propuestas interpretativas, de lege ferenda y recomendaciones que puedan contribuir a alimentar un debate imprescindible sobre la mejor manera de abordar los asuntos penales por parte de los medios de comunicación.

abstract = {Based on different journalistic articles related to one particular case, the frictions between both, the right to inform and the right to be informed and on the other hand the respect of the fundamental rights of persons involved in criminal proceedings, are analysed. Questions such as the safeguard of the confidentiality of judicial investigations, respect to the extra procedural dimension of the presumption of innocence, safeguarding of the right to honour, privacy and personal image of the participants in criminal proceedings are confronted with the freedom of the press. The current situation is presented according to legislative, judicial and ethical terms, with the aim of developing interpretative proposals, lege ferenda proposals and further recommendations that can help initiating an essential discussion about the best way to deal with criminal matters in media.},
