T1 Mercado de trabajo y principio de igualdad

AB La necesidad de medidas efectivas para garantizar la igualdad de oportunidades en el mercado laboral es inobjetable. No obstante, hay que tener presente el importante papel reconocido a la libertad de empresa y, consecuentemente, la necesidad de ponderar los derechos e intereses en juego y buscar puntos de equilibrio entre ellos. Ello explica que la consecución de la igualdad se canalice jurídicamente a través de dos vías complementarias. Por un lado, mediante la adopción de medidas de acción positiva dirigidas a favorecer la posición en el mercado de trabajo de determinados colectivos especialmente vulnerables. Por otro lado, a través de mecanismos dirigidos a marcar con nitidez los límites en los que debe quedar circunscrito el principio de libertad de empresa en el ámbito de las relaciones laborales._______________________________The need of effective measures to guarantee the equality of opportunities on thelobour market cannot be objected. It, nevertheless, it is necessary to consider theimportance of the role that gives it to the freedom of company and, consistently,the need to consider the rights and interests in game and to look for points ofbalance between them.This explains that the attainment of the equality should canalize juridically acrosstwo complementary routes. On the one hand, by means of the adoption of measuresof positive action directed to favoring the position on the labor market ofcertain specially vulnerable groups. One the other hand, across mechanisms directedto marking with clarity the limits in which it must remain limited theprinciple of freedom of company in the area of the labour relations.
