AB El artículo trata de la transformación jurídica habida en España tras la dictadura del General Franco(1939.1975) y su conversión en democracia tras su muerte el 20 noviembre 1975. El primer paso para esa transformaciónlo dieron algunos políticos del anterior régimen, pero pronto, tras la legalización de los partidos políticosy la convocatoria de unas Elecciones Generales en 1977, se redactó con la colaboración de los principales partidosuna nueva Constitución que fue aprobada por Referendum en diciembre 1978. Desde entonces ha continuado latransformación jurídica del sistema jurídico de la dictadura en uno democrático. La mayoría de las reformas han sidopenales y desde 1995 hay un nuevo Código penal. Actualmente los problemas más importantes son la distribuciónde competencias y del poder entre las Comunidades Autónomas y el terrorismo generado por el movimiento independentistavasco ETA
AB This paper is about the legal transformation of the Spanish dictatorship of General Franco (1939-1975)to a democracy.The first step started after Franco´s death (20.November 1975) and was conducted by politicians who did play a role duringthe last years of the dictatorship. But after the legalisation of all parties and the General Elections in June 1977 wasenacted with collaboration of the most important parties and aproved by Referendum the new Constitution (December1978). Since then the legal transformation has been continued and has changed the legal order from the dictatorship toa democratic system. The most important legal reforms were the penal reforms, and 1995 was enacted a new Penal Code.But now there are still problems about the territorial and power distribution between the Comunidades Autónomas andthe movements for the Independency of Basquish Country, that generated as well a terror actions from ETA
