T1 La importación como delito contra la propiedad industrial

AB En este breve estudio se intenta realizar una aproximación a la importación como modalidad delictivaprevista en el art. 273.1 del Código Penal, es decir, a la importación de productos infractores de determinados derechosde propiedad industrial. De manera puntual, se trata de abordar las particularidades que presenta esta conductaderivadas de la especial naturaleza del objeto sobre el cual recae, así como de los diversos instrumentos jurídicosnacionales, comunitarios e internacionales que rigen los correspondientes derechos. Finalmente, se analiza lasituación de las importaciones paralelas, a fin de determinar su inclusión en el marco del delito previsto en el indicadoartículo del Código Penal español
AB This short study is an attempt to carry out an approach to studying imports as a criminal form foreseenin article 273 of the Spanish penal code, that is, importation of products that violates certain rights of industrialproperty. More clearly, the particularities that present this conduct derived from the special nature of the object overwhich it rests are studied, as well as, the diverse national, community and international legal instruments that regulatethe corresponding rights. Finally, the situation of parallel imports is analyzed in order to determine their inclusionin the framework of a crime foreseen in the indicated article of the Spanish criminal code
