AB A specific status for the non communitarian immigrants can be found for Italian criminal law. In thispaper, by means of a «dogmatic» and criminal policy analysis of criminal law rules and the latest reform proposals,we will deal with the problem of whether that status violates the rights of non communitarian citizens and constitutean example of criminal law based on the personal characteristics rather than on facts
