T1 La agravante de reincidencia en el Código penal español. Consideraciones de política criminal

AB En el presente trabajo se aborda el tema del delincuente habitual plenamente imputable, analizando las distintas opciones para su tratamiento jurídico-penal. Así, se considerará la conveniencia de recurrir a un sistema monista a través de la exasperación de la respuesta punitiva o, bien, a una respuesta dualista mediante la aplicación de medidas de seguridad. A partir del estudio de la constitucionalidad y la fundamentación de estas opciones se pretende llegar a una conclusión sobre las bondades de su adopción, así como sobre su posible justificación.---------------------------------------------------------------------------------------------------------
AB The need to increase the level of security of the society has led to Criminal Law to consider the best legal response against the habitual offender. This paper examines the possibility of using a system that imposes additional punishment or security measures. It will consider the constitutionality and the merits of these options to reach a conclusion on the advisability of its adoption.
