AB Aunque existe una coordinación social, formal y coercitiva que exigela observancia de la ley, en el sistema de impartición de justicia frecuentemente puede apreciarse la exégesis androcéntrica de los juzgadores. Este sistemanormativo creado, aplicado e interpretado desde la masculinidad tradicional,categoriza por medio del derecho a las buenas mujeres dentro de la ley, ymalas mujeres fuera de la ley. El objetivo de la presente reflexión consiste enprefigurar pautas para reivindicar la dignidad de las mujeres en el acceso a lajusticia como sujetos marginados por la heteroaplicatividad de la norma patriarcal. El aspecto metodológico de la presente investigación es de corte cualitativo estrictamente documental. Entre los hallazgos principales de la presente,se encuentra que el feminismo es una configuración efectiva de teoría de lajusticia que responde a las necesidades de las mujeres acorde a sus contextossociales, y que, además, esta praxis no puede ajustarse a una única teoríauniversalista de justicia ya que no existe una unívoca categoría de mujer. Estoa su vez implica que, las mujeres tengan la prerrogativa a presentar el derechoa ser malas mujeres
AB Although there is a social, formal and coercive coordination thatrequires the observance of the law, in the system of administration of justice theandrocentric exegesis of the judges can often be appreciated. This normativesystem created, applied and interpreted from the traditional masculinity,categorizes by means of the right good women within the law, and bad womenoutside the law. The objective of this reflection is to prefigure guidelines tovindicate the dignity of women in access to justice as marginalized subjectsdue to the hetero-applicability of the patriarchal norm. The methodologicalaspect of this research is of a strictly documentary qualitative nature. Amongthe main findings of the present, it is found that feminism is an effective configuration of the theory of justicethat responds to the needs of womenaccording to their social contexts, andthat furthermore, this action cannotbe adjusted to a single universalisttheory. of justice since there is nounambiguous category of woman.This in turn implies that, women havethe prerogative to present the right tobe bad women
