T1 Latin America facing investor-state claims

AB Este artículo estudia las demandas presentadas por empresasmultinacionales contra estados latinoamericanos en instancias internacionalesde arbitraje. Como esas demandas derivan de la suscripción de numerososacuerdos internacionales sobre inversión, se plantean los límites que para lapuesta en práctica de estrategias de desarrollo suponen dichos acuerdos. Luegose repasan las respuestas dadas por varios países de la región a fin de superarel obstáculo que esas demandas suponen, considerándolas insuficientes. Comoalternativa, se propone retomar la doctrina Calvo, recuperando la soberaníajurisdiccional de cada estado.
AB This paper studies the claims of Multinational Enterprises againstLatinamerican States at international arbitration instances. As these claimsstem from the subscription of multiple international agreements on investment,the convenience of such agreements for the achievement of develoment goalsis at stake. Our work goes on revising the reactions of several of the region’sstates in order to overcome the inconvenience of such claims, considering theminsufficient.
