T1 Por una convención internacional contra los ecocrímenes y un tribunal internacional del medioambiente

AB Este trabajo toma postura a favor de la adopción de una Convención Internacional que castiguelos atentados más graves contra el medioambiente global, en línea con las propuestas de la sociedad civily la comunidad científica. Analizamos las conductas que deberían prohibirse en esta convención: el ecocidio —que es el delito medioambiental internacional que más consenso reúne—, el expolio de recursosnaturales y los delitos ecológicos transfronterizos. Además, se estudia la cuestión de la autoridad judicialque juzgaría esos crímenes; se examinan diversas posibilidades: la Corte Penal Internacional, la CorteInternacional de Justicia y la creación de un nuevo Tribunal Internacional del Medioambiente
AB This paper takes side with the adoption of an International Convention to sanction the mostserious attacks against the global environment, in line with the proposals of civil society and the scientificcommunity. We analyze the behaviors that should be prohibited in this convention: ecocide —the international environmental crime that gathers the most consensus—, the spoliation of natural resources andtrasnational ecological crimes. In addition, we also study the question of the judicial authority with competence to investigate and judge these crimes: and various possibilities are examined: International Courtof Justice, International Criminal Court and the creation of a new International Court for the Environment
