T1 El ciudadano extracomunitario: de “objeto material” a “tipo de autor” en el control penal de la inmigración

AB En el Derecho penal italiano existe un estatus específico para el inmigrante extracomunitario.En este artículo afrontamos, mediante el análisis dogmático y político-criminal de la legislación penaly de las últimas propuestas de reforma, el problema de hasta qué punto tal estatus vulnera las garantíasdel ciudadano extracomunitario y genera un Derecho penal de autor.
AB A specific status for the non communitarian immigrants can be found for Italian criminallaw. In this paper, by means of a “dogmatic” and criminal policy analysis of criminal law rules and thelatest reform proposals, we will deal with the problem of whether that status violates the rights of noncommunitarian citizens and constitute an example of criminal law based on the personal characteristicsrather than on facts.
