T1 La superación jurídico-penal de las injusticias y actos antijurídicos nacionalsocialistas y realsocialistas en Alemania

AB Alemania tuvo que superar la transición1 de un sistema totalitario a un sistema democrático en dosoportunidades durante el siglo pasado: por una parte durante la lenta elaboración de las injusticias e ilegalidadespropias del nacionalsocialismo desde el fin de la Segunda Guerra Mundial (8 de mayo de 1945), por otra parte durantela elaboración de la criminalidad, propia del sistema de la República Democrática Alemana (RDA) desde lacaída del muro de Berlín (9 de noviembre de 1989) y la consiguiente adhesión de la RDA a la República Federal deAlemania (RFA) (3 de octubre de 1990). El artículo describe y analiza, particularmente desde un punto de vista jurídico-penal, las medidas tomadas y los mecanismos aplicados en ambos procesos de transición, así como el impactoque estos tuvieron para la creación del orden social y democrático existente en Alemania
AB Deutschland musste den Übergang von einem totalitären zu einem demokratischen System im vergangenenJahrhundert gleich zweimal bewältigen: zum einen bei der langwierigen Aufarbeitung des NS-Unrechts ab Endedes 2. Weltkrieges (8. Mai 1945), zum anderen bei der Aufarbeitung der Systemkriminalität der Deutschen DemokratischenRepublik (DDR) ab dem Fall der Mauer (9. November 1989) und dem darauf folgenden Beitritt der DDR zurBundesrepublik Deutschland (BRD) (3. Oktober 1990). Der Beitrag erläutert und analysiert vornehmlich aus strafrechtlicherSicht die in beiden Übergangsprozessen getroffenen bzw. angewandten Maßnahmen und Mechanismen sowiederen Bedeutung für die Entwicklung der bestehenden demokratischen Gesellschaftsordnung in Deutschland
AB Germany had to overcome the transition from a totalitarian system into a democratic one two times over the last century: On one hand during the slow elaboration of injustices and illegalities proper to Nacional Socialism since the end of the Second World War (May 8, 1945), on the other hand, the elaboration of the criminality, typical of the German Democratic Republic system (GDR) since the fall of the Berlin Wall (November 9, 1989) and the consequent accession of the GDR tot eh Federal Republic of Germany (FRG) (October 3, 1990).  This paper describes and analyses, particularly form a legal point of view, the measures and mechanisms applied in both transition processes, as well as the impact they had for the creation of the existing social and democratic order in Germany.
