AB El artículo trata de los límites jurídicos a la valoración de las pruebas en el proceso penal.Se analizan y comentan diversas decisiones judiciales, en las que no se respeta el derecho del acusado a no autoincriminarse,y la posibilidad de que se admitan pruebas obtenidas mediante escuchas domiciliarias. En elartículo también se denuncian los casos de tortura y malos tratos a que son sometidos los presos en Guantánamoy algunas teorías jurídicas que justifican o asumen la impunidad de estas prácticas. AB This article is about legal limits on Evidence Law. First it comments decisions about the rights of thedetainees to a due process and to remain in silence and not to make self-incriminating statements. The article takesas well a critical look at the possibility to use as evidence audiovisual technical systems to tape conversations insidethe home belonging to the privacy and torture as a form of policy and at certain legal theories that justify politicaland military officials implicated in torture and abuse of those prisoners
