T2 Classified Information in Times of Transparency: a Comparative Analysis of Official Secrets Policies

AB Uno de los elementos que forman parte del debate actual sobre la calidad de la democracia se vincula con la existencia de determinados ámbitos de actuación de los poderes públicos que por razón de su naturaleza se sustraen a los principios generales de publicidad y transparencia. El debate sobre el acceso a la información pública ha puesto de manifiesto, nuevamente, la regulación sobre los secretos oficiales. El artículo analiza siete países europeos (Francia, Reino Unido, Alemania, Holanda, Suecia, Portugal e Italia) analiza y modeliza su política de información clasificada a partir del estudio de cuatro dimensiones: regulación normativa, órganos de clasificación, parámetros temporales de la clasificación y categorías de tratamiento para determinar si tienden a favorecer la posición institucional o el escrutinio público.
AB One of the elements that are part of the current debate on the quality of democracy is linked to the existence of certain spheres of action of the public powers that, due to their nature, are subtracted from the general principles of publicity and transparency. The debate on access to public information has revealed, once again, the regulation of official secrets. The paper analyzes seven European countries (France, United Kingdom, Germany, Holland, Sweden, Portugal and Italy) analyzes and models their classified information policy from the study of four dimensions: normative regulation, classification bodies, temporal parameters of the classification and treatment categories to determine whether they tend to favor institutional standing or public scrutiny.
