AB Se profundiza en la desigualdad jurídicaen materia matrimonial entre mujeresy hombres durante el Antiguo Régimen,teniendo en cuenta la influencia de la legislaciónmedieval en las cuestiones relativasa las mujeres casadas adúlteras. Se analizala tipificación del delito y el procedimientode acusación, así como las penas corporalesy pecuniarias a las que tenían que hacerfrente las casadas y los amantes de estas.Asimismo, se tienen en consideración lasleyes que prohibían otros delitos sexualesque conllevaban la infidelidad entre losesposos, por lo que se analiza también labigamia y el amancebamiento de mujeresy hombres casados, junto con la prostituciónpor parte de mujeres casadas. Se hacehincapié en una mayor impunidad para losvarones infieles y el castigo a las mujeresadúlteras por parte de la justicia.
AB It is analyzed the legal inequality in marital matters between women and men during the Old Regime, taking into account the influence of medieval legislation on issues relating to adulterous married women. It is studied the classification of the crime and the prosecution procedure, as well as the corporal and pecuniary penalties that married women and their lovers had to face. Likewise, it is investigated about the laws that prohibited other sexual crimes that entailed infidelity between the spouses, for which it is also analyzed the bigamy and concubinage between married women and men, along with prostitution by married women. It is emphasized a greater impunity for unfaithful men and the punishment of adulterous women by justice.
