AB La tendencia del legislador penal español de los últimos tiempos ha sido incrementar e intensificar sin límite la legislación penal. Pero más alarmante es aún ante la criminalización de los discursosextremos y el llamado discurso del odio terrorista. Ante el miedo que generan los ataques terroristas, ellegislador penal, a veces movido por mandatos internacionales, y otras por reclamos sociales, ha vistojustificado adelantar las barreras de intervención penal a momentos muy previos a la efectiva lesión debienes jurídicos para tratar de inocuizar cualquier posible conducta terrorista y para ello no ha tenidoproblema en poner en juego la seguridad y garantías de nuestro propio Estado de derecho y poner en jaquederechos como la libertad de expresión
AB : The tendency of the Spanish criminal legislator in recent times has been to increase and intensifycriminal legislation without limit. But even more alarming is the criminalization of extreme speech and theso-called terrorist hate speech. Faced with the fear generated by terrorist attacks, the criminal legislator,sometimes moved by international mandates and others by social demands, has seen it justified to advancethe barriers of criminal intervention to moments long before the effective damage to legal rights to try toinnocuous any possible terrorist behavior and for this it has had no problem putting the security and guarantees of our own rule of law at stake and putting rights such as freedom of expression in check
