T1 Ley General Tributaria - Responsabilidad Tributaria - Contratación y Subcontratación

AB En España, la actividad constructora e inmobiliariaes considerada por la Administración como unárea de riesgo fiscal de atención prioritaria por laInspección Financiera y Tributaria1, y por ello, ellegislador, con motivo de la aprobación de la Ley58/2003, de 17 de Diciembre, General Tributaria -en adelante LGT- y de cara a combatir las bolsas defraude fiscal existentes en dicho sector3, ha creídoidóneo para tal fin transponer al ámbito tributarioel supuesto de responsabilidad regulado en elartículo 42 del Real Decreto Legislativo 1/1995, de24 de marzo, por el que se aprueba el TextoRefundido de la Ley del Estatuto de losTrabajadores -en adelante ET-, estableciéndose asíen el artículo 43. 1 letra f) LGT un supuesto deresponsabilidad tributaria en la contratación y lasubcontratación que supone una de la mayoresnovedades introducidas por la LGT.
AB In Spain, real state and building construction areconsidered by Government Administration as atax risk area of a major concern for theDepartment of Treasury. Therefore, following theapproval of the General Tax Law (LGT) 58/2003on December 17th, and in order to fight tax evasionin this sector, liabilities regulated in Article 42of the Royal Act (Real Decreto Legislativo)1/1995 from March 24th, wherein the TextRevised of the Workers’ Statute (ET) wasapproved, will be handled to the Department ofTreasury. Whereby, tax liabilities in contracting andsubcontracting established on the article 43. 1 f)LGT results in one of the newest features introducedby this General Tax Law.
