T1 Terrorismo internacional: rasgos esenciales de su configuración

AB El hecho de que el terrorismo sea internacional no altera la esencia de su significación antijurídica, puesla conducta se agotará con independencia de sus dimensiones territoriales, siendo en todo caso indispensable que,por lo menos, se verifique la existencia de tres elementos, esto es, el empleo de la violencia, la amenaza de llevarlaa cabo —primer elemento— con objeto de generar terror, miedo o incertidumbre —segundo elemento— y conello un estado de inestabilidad en el orden político —tercer elemento. Podrá variar el potencial de su lesividadmaterial, la forma en que se manifieste y sus alcances, pero no los componentes básicos de su configuración.A pesar de existir consenso, incluso internacional, en torno a esa configuración antijurídica, después de 16 años,hasta la fecha no se ha logrado estructurar un concepto normativo de terrorismo internacional en el marco delas Naciones Unidas. Parece ser que esa falta de concreción responde a una discrepancia de carácter político.
AB The fact that terrorism is international does not modify the essence of its unlawful nature, for theconduct will be exhausted independently of its territorial extent, being in any case indispensable that at leastthe presence of three elements is checked out: i.e. the use of violence and the threat to carry it out —firstelement— with the aim to produce terror, fear, and uncertainty —second element—, and an accompanyingstate of instability in the political order —third element. The potential of its material harmfulness, the wayit expresses itself, and its scope could change, but not the basic elements in its configuration. Although thereis a consensus, even international, about this anti-juridical configuration, until now, after 16 years, in theUnited Nations it has not been possible to put together a regulating concept for international terrorism.This lack of result originates seemingly from a disagreement of a political kind.
