AB Este artículo pretende ofrecer posibles soluciones dentro del entramado constitucional mexicanoa los problemas derivados de figuras como la prisión preventiva oficiosa y su incompatibilidad con losderechos fundamentales internacionales. Con el fin de alcanzar este objetivo, este artículo analiza y cuestionacriterios como el principio pro persona y el criterio jurisprudencial establecido por la ct 293/2011.Finalmente, se ofrecerá un modelo dogmático como base de la ponderación convencionalizada y sus efectosen la prisión preventiva oficiosa.
AB This article aims to offer possible solutions within the Mexican constitutional framework to theproblems derived from concepts as the mandatory pre-trial detention and its incompatibility with internationalfundamental rights. To achieve this objective, this article analyzes and criticizes criteria such as thepro homine principle and the judicial precedent established by the ct 293/2011. Finally, a dogmatic modelis offered as a basis for the conventionalized balancing and its effects on mandatory pre-trial detention.
