AB El delito de trata de seres humanos se introdujo en el ordenamiento jurídico español en 2010. La Directiva 2011/36/UE obligó a los Estados miembros a cumplir unos estándares mínimos en la persecución penal del de-lito de trata, lo que en España dio lugar a la modificación de la regulación de este delito en 2015. Por otro lado, en 2024 se aprobó una nueva norma en la Unión Europea en esta materia, la Directiva (UE) 2024/1712, que entró en vigor el 14 de julio y que modificó la Directiva de 2011 incluyendo imposiciones más severas para combatir la trata. El presente trabajo tiene como finalidad analizar si la actual regulación española cumple los requisitos de ambas Directivas o si, por el contrario, es necesaria alguna reforma legal para adaptar nuestro ordenamiento a las exigencias comunitarias.---------------------------------------------------------------------------------------------------------
AB The crime of trafficking in human beings was introduced into the Spanish legal system in 2010. Directive 2011/36/EU obliged Member States to comply with minimum standards, which in Spain led to the modification of the regulation of this crime in 2015. However, in 2024, a new European Union regulation was approved in this area, Directive (EU) 2024/1712, which entered into force on 14 July and which amended the previous one by including harsher requirements to combat trafficking. The aim of this paper is to analyze whether the current Spanish regulation meets the requirements of both Directives or whether, on the contrary, some legal reform is necessary to adapt our legal system to the eu requirements.
