T1 El mal menor: polémicas medidas de seguridad pública y prevención del delito

AB La percepción social del incremento de la delincuencia, sumada al sentimiento de desprotección ante el delito, suscita una fuerte aversión hacia el delincuente. Consecuentemente, la intolerancia al riesgo de las sociedades ha desatado una querencia en favor del discurso totalizante de la seguridad. Así, el mantenimiento de la seguridad debe constituir el fin del Estado y el objeto de su actividad. Las estrategias de seguridad frente al delito articuladas en base a la teorización del mal menor han cobrado renovado protagonismo en su afán de proteger los derechos, las libertades y el bienestar de los ciudadanos. Su legitimidad legal inicial se diluye cuando su articulación y desarrollo se ejecuta tratando de eludir la debida sujeción a los controles jurídico-constitucionales, amparándose en la máxima latina salus reipublicae suprema lex, esto es, que la seguridad del Estado debe ser la ley suprema. En nombre de la seguridad del pueblo, se asume el sacrificio de las demás leyes. Cuestión que podría interpretarse como la pretensión de excluir del ámbito de control jurídico todo lo concerniente a la seguridad. Sin duda, una temática no exenta de debate.
AB The social perception of the increase in crime, added to the feeling of lack of protection inthe face of crime, arouses a strong aversion towards the delinquent. Consequently, the risk intolerance ofsocieties has unleashed a desire in favor of the totalizing discourse of security. Thus, the maintenance ofsecurity must constitute the purpose of the State and the object of its activity. Security strategies againstcrime articulated based on the theorization of the lesser evil have gained renewed prominence in theirdesire to protect the rights, freedoms, and well-being of citizens. Its initial legal legitimacy is diluted whenits articulation and development is carried out trying to avoid the due subjection to legal-constitutionalcontrols, relying on the Latin maxim salus reipublicae suprema lex, that is, that the security of the Statemust be the supreme law. In the name of the safety of the people, the sacrifice of the other laws is assumed.Question which could be interpreted as the claim to exclude everything related to security from the scopeof legal control. Undoubtedly, a subject does not exempt from debate.
