AB Este aporte tiene como base un amicus curiae en una causa judicial en la República del Perú sobre la fundamental relación de dos principios constitucionales elementales en el Derecho Penal: la contradicción entre el derecho al honor de los funcionarios públicos y el derecho a la libre expresión de los ciudadanos. El análisis de derecho se realiza según el sistema penal alemán como aporte a la discusión doctrinaria peruana y colaboración con la judicatura peruana en la búsqueda de los mejores argumentos.---------------------------------------------------------------------------------------------------------
AB This contribution is based on an amicus curiae regarding a criminal case in the Republic of Peru about the fundamental relation of two elementary constitutional principles in the Penal law: the contradiction between the right to be respected in one’s social standing (honor) on the one side and the right to freedom of expression on the other. The legal analysis is conducted according to the German penal system, aiming at contributing to the Peruvian legal doctrine and collaborating with the Peruvian judiciary in the search of the best legal arguments.
