AB Llevamos tres años debatiendo la propuesta de modificación del artículo 763 de la Ley de Enjuiciamiento Civil (L.E.C.) con el objeto de autorizar expresamente tratamientos ambulatorios involuntarios de los enfermos mentales. A muchos nos parece una iniciativa innecesaria dado que los tratamientos involuntarios, para todo tipo de pacientes y en todo tipo de circunstancias están contemplados en las leyes vigentes (Convenio de Oviedo, Ley 41/02 de Autonomía, etc.). Se trata, en el fondo, de un nuevo intento de judicializar la asistencia psiquiátrica, expresión de las importantes resistencias sociales, institucionales y corporativas para reconocer la ciudadanía de los enfermos mentales y su plena equiparación a otras clases de enfermos, tal y como recogen las leyes en vigor en nuestro país, desde la promulgación de la Constitución de 1978.
AB We have already been three years debating the proposal of modification ofthe article 763 of the Law of Civil Judgement (L.E.C.) with the purpose of explicitlyauthorising involuntary outpatient treatments for psychiatric patients. To manyof us, this seems an unnecessary initiative, given that the involuntary processingfor all kinds of patients and in all kinds of circumstances are already contemplatedin the laws in force (Covenant of Oviedo, Law 41/02 of Autonomy etc.). In fact,this is new attempt to transform psychiatric assistance into a judicial process,which is the expression of the important corporate, institutional, and socialresistances to recognize the citizenship of the mentally sick and their fullcomparison to other kinds of patients, just as inforced by the current laws in ourcountry, since the promulgation of the Constitution of 1978
