T1 Metodologías activas para un aprendizaje del derecho romano basado en problemas : herencia, dote y régimen económico del matrimonio romano

AB Con la realización del presente trabajo pretendemos investigar sobre laimportancia actual de aplicar el aprendizaje basado en problemas a la enseñanza delDerecho Romano, frente a las tradicionales clases teóricas y magistrales. Incidiendo enel alcance de las exigencias metodológicas surgidas con los nuevos planes del estudiodel Grado en Derecho, en el marco del EEES; así como en el desarrollo de una serie decompetencias en los estudiantes, que les van a ser muy útiles una vez que finalicen y seenfrenten a las dificultades del mercado de trabajo, ya que se consideran como losverdaderos protagonistas del proceso de enseñanza-aprendizaje. Por tanto, con la puestaen práctica de este primer caso sobre el régimen económico del matrimonio frente aotras parejas de hecho como el concubinato, la dote y el papel de la mujer, las formas deesclavitud o la herencia, acercamos al alumnado al casuismo romano afianzando lasideas ya estudiadas; de este modo, comprenderán que lo importante no es dar lasolución sino razonar jurídicamente consiguiendo, a través de debates en grupo y eltrabajo personal, un conocimiento más profundo de las reglas e instituciones aplicables.
AB With the accomplishment of the writing that follow we pretended toinvestigate what the current importance of applying the learning through problems inthe teaching of Roman Law, against the traditional theoretical and magistral classes.Influencing in the reach of the methodological requirements emerged with the newplans of study Law Degree, under the EEES; as well, in the development of a set ofskills in students, that will be very helpful once time they finish and face the difficultiesof today's labor market, because they are the true protagonists of the teaching andlearning process. Therefore, with the implementation of this first case about theeconomic regime of marriage compared with other unmarried partners as concubinage,dowry and the role of women, forms of servitude or inheritance, we approach thestudents to casuism roman jurisprudence completing the ideas seen in the previouspractice; in this way, they will understand that the important thing is not to give thesolution to case proposed but legal reasoning, through discussions in groups andpersonal work, getting a deeper knowledge of applicable rules and institutions.
