AB La sentencia United States v. Windsor, Executor of the Estate ofSpyer, et al. de 26 de junio del 2013 declara la inconstitucionalidad de la leyfederal MOMA que hasta entonces limitaba el significado del término matrimonioa “una unión legal entre un hombre y una mujer” en los EstadosUnidos de América. Destaca, sin embargo, por su ausencia cualquier referenciaa la práctica jurídica comparada o al Derecho internacional en el razonamientodel Tribunal Supremo en una sentencia que se halla destinada aposeer un importante valor simbólico en el marco del Derecho constitucionalcomparado en el área de la legalización de matrimonios entre personas delmismo sexo. El presente artículo examina cómo la interpretación judicial de laConstitución estadounidense se debate entre los extremos del aislacionismojurídico soberanista y la apertura al Derecho global del siglo XXI.
AB United States v. Windsor, Executor of the Estate of Spyer, et al.(26th June 2013) declares the inconstitutionality of Section III of MOMAwhich is a federal law that used to limit the meaning of the term “marriage”to the “legal union between a man and a woman” in the United Statesof America. The absence of any reference to comparative legal practiceor international law in the legal reasoning of the U.S. Supreme Court in acase which is bound to have a symbolic role in the future of comparativeconstitutional law in the area of same-sex marriages is striking. This articleexamines how the interpretation of the Constitution of the United States iscurrently strained between two extremes: a sovereignist-type of legal aislationismand the embracement of the global law of the 21st Century.
