abstract = {Se considera que las decisiones empresariales demasiado arriesgadas es una de las causas principales de la crisis económica actual (por ejemplo, las especulaciones con títulos de valor inseguros o el otorgamiento de créditos sin la debida diligencia). Sin llegar a analizar los orígenes de la crisis, el artículo se refiere a la eventual responsabilidad penal por actos como los descritos supra en tres economías importantes de Europa: Alemania, Francia y Polonia. Además se ofrece un análisis dogmático comparado y se presenta el concepto de riesgo relevante para este tipo de delitos. A su vez el artículo pretende contestar a la pregunta sí una armonización de la definición de los delitos examinados no tendría justificación a la luz de los desarrollos económicos más recientes y del artículo 83 apartado 1 del nuevo Tratado de Funcionamiento de la Unión Europea.

abstract = {Business decisions which bear too much risk are considered as one of the most important causes of the present economic crisis. These can entail speculations with securities having high risk level or granting credits to insecure debtors. Without entering into discussion about the origins of the crisis, this article aims at analysing the possible criminal responsibility for such acts in three important economies of Europe: France, Germany and Poland. Moreover the text provides for a dogmatical comparative analysis and presents the notion of risk relevant to the criminal responsibility for the offences in question. In addition the text attempts at resolving the issue of whether harmonisation of definitions of offences in question would be justified in the light of the recent economic developments and according to the new article 83 of the Treaty on the Functioning of the European Union.},
