Se trata de un mecanismo jurídico que constituye la más viva expresión del principio de autodefensa. Su relevancia radica, de un lado, en su presencia a todos los niveles del ordenamiento jurídico: internacional, constitucional y legal, y de otro, en su profusa aplicación por los tribunales. Tanto el Tribunal Constitucional como el Tribunal Supremo o las Audiencias Provinciales han dedicado numerosas sentencias al análisis de esta institución jurídico-penal.This articles analyses the right to have the final say as a fundamental right, di-rectly linked to the right of defence. It is a legal mechanism which constitutes the most vivid expression of the principle of self-defense. Its relevance lies, on the one hand, on, its presence in all levels of the legal system (o legal order) and, on the oth-er hand, on its usual application by courts.
