Se analiza la tipificación del delito y el procedimiento de acusación, así como las penas corporales y pecuniarias a las que tenían que hacer frente las casadas y los amantes de estas. Asimismo, se tienen en consideración las leyes que prohibían otros delitos sexuales que conllevaban la infidelidad entre los esposos, por lo que se analiza también la bigamia y el amancebamiento de mujeres y hombres casados, junto con la prostitución por parte de mujeres casadas. Se hace hincapié en una mayor impunidad para los varones infieles y el castigo a las mujeres adúlteras por parte de la justicia.It is analyzed the legal inequality in marital matters between women and men during the Old Regime, taking into account the influence of medieval legislation on issues relating to adulterous married women. It is studied the classification of the crime and the prosecution procedure, as well as the corporal and pecuniary penalties that married women and their lovers had to face. Likewise, it is investigated about the laws that prohibited other sexual crimes that entailed infidelity between the spouses, for which it is also analyzed the bigamy and concubinage between married women and men, along with prostitution by married women.
