Sin embargo, no puede considerarse acertada la técnica legislativa del artículo 307 ter al no tratar por igual al empresario y al trabajador; por no establecer un umbral mínimo a modo de condición objetiva de punibilidad; y por confundir la intensidad penológica de los cómplices del delito con respecto de los autores. Ya se han pronunciado distintos órganos judiciales ofreciendo criterios interpretativos acerca del tipo penal, motivo por el cual se pretende traer a colación algunos comentarios, apuntes y propuestas. ---------------------------------------------------------------------------------------------------------This paper intends to show a crime that was introduced into the criminal law in 2012, punishing some behaviors that, previously, were referred to other crimes. However, the wording of the provision is not correct as it does not treat the employer and the worker equally; for not establishing a minimum threshold as an objective condition of punishability; and for confusing the penological intensity of the accomplices of the crime with respect to the perpetrators.
