El fenómeno del derecho sancionador administrativo en la Unión Europea obedecía a peculiaridades nacionales. Existiendo varios modelos diferentes. El derecho de la Unión europea y la jurisprudencia del Tribunal Europeo de Derechos Humanos los han acercado notablemente, unificando los principios bajo los que resulta legítimo la imposición de sanciones. This area of the national legal system contents traditionally a high degree of national specificities, therefore exists different nationals models. The EU Law and the case law of the European Court of Human Rights has approached these different models. So today the principles are similar according to these sanctions that should be imposed.
