Abstract

En su camino de modernización del proceso penal —presupuesto de la futura y necesaria globalización— Francia ha dado el primer paso, superando así el punto de inflexión que hace la reforma irreversible. El informe de la Comisión Léger, que supone un análisis integral de los problemas esenciales del proceso penal, es el resultado de un compromiso directo del Presidente de la República Nicolas Sarkozy. Las páginas que siguen son la síntesis de dicho documento, cuya completa implementación supondrá el abandono definitivo del modelo procesal penal basado en la figura del juez de instrucción. ---------------------------------------------------------------------------------------------------------

On its way to modernization of the criminal procedure —condition of the future and necessary globalization of the legal system— France has taken the first step, reaching a tipping point that makes the reform irreversible. The report of the Léger Commission, representing a comprehensive analysis of key issues in the criminal process, is the result of a direct commitment from the President of the Republic Nicolas Sarkozy. The following pages are the summary of this document, whose whole implementation will mean the definitive abandonment of the model based on the figure of the juez de instrucción.
