Mobbing y negociación colectiva

Abstract

El objeto de este trabajo es el estudio del tratamiento que el mobbing recibe en la negociación colectiva española, identificando y analizando las cláusulas convencionales que se ocupan de este problema, valorándolas y señalando sus principales logros y carencias. Se trabajará con la realidad negocial de nuestro país, sobre convenios efectivamente vigentes, seleccionados por su relevancia o calidad. Asumimos un conocimiento mínimo de lo que el mobbing es como fenómeno social con trascendencia jurídica, y de los instrumentos dispuestos por el ordenamiento jurídico para su prevención y reparación, por lo que no entraremos en estas cuestiones. Como también lo presumimos respecto de la negociación colectiva, tanto en sus aspectos legales como en cuanto a las características del sistema español.

The aim of this work is to study the treatment of mobbing in the Spanish collective bargaining, by indentifying and analysing the treaty provisions that deal with this problem, evaluating them and pointing out their main achievements and shortcomings. We will work with the business reality of our country about effectively existing conventions, selected for their relevance or quality. We assume a minimum knowledge of what mobbing is as a social phenomenon with legal significance, and of the instruments set out by the legal system to the prevention and reparation, so we will not enter into these issues. In addition, we presume it with regard to collective bargaining, both in its legal aspects and concerning the characteristics of the Spanish system.
