Abstract
La legislación laboral, a través de las técnicas propias de la delegación normativa y el establecimiento
del carácter dispositivo de parte de la misma, habilita a la negociación colectiva para
concretar el régimen jurídico y las condiciones de determinados contratos de trabajo. Muy especialmente,
de dos de los denominados contratos temporales estructurales (eventual y por obra o servicio),
sin duda, principales y destacados protagonistas de nuestro mercado de trabajo.
En las líneas que siguen se tratará pues de contrastar y determinar como los sujetos negociadores
han aceptado y desarrollado este mandato en el ámbito de la comunidad autónoma de Andalucía
y en qué grado resultan eficaces o eficientes dichas remisiones efectuadas por el legislador
laboral. Lo que requiere, en primer lugar, delimitar la técnica de selección de los convenios colectivos
a analizar; para, en segundo lugar, resaltar sus principales innovaciones y las posibles dificultades que
puedan presentar.
Labour legislation, through its own techniques of legal delegation and establishing its own deployment nature, authorises collective bargaining to specify the legal scheme and conditions of certain employment contracts. In particular, two of the so–called structural fixed–term contracts (temporary and service contracts) are undoubtedly the main protagonists of our labour market. This work will therefore try to contrast and determine how negotiating agents have accepted and developed this mandate in the sphere of the Autonomous Community of Andalusia and to what degree these referrals made by the labour legislator are efficacious and efficient. This requires, in first place, to limit the selection technique of the collective agreements to be analysed; and, secondly, highlight the main innovations and possible difficulties they may present.
