El tratamiento jurídico y jurisdiccional de los secretos de Estado siempre genera polémicas. Se presentan problemas a la hora de la investigación judicial de las actividades secretas del Estado (fondos reservados, responsabilidad de funcionarios, etc.). Se concluye que la justicia siempre tiene potestad para investigar todos los delitos, pero los jueces no son competentes para revelar materias clasificadas legalmente.

The jurisdictional and legal handling of State secrets always generates polemics. Problems come forward when carrying out the judicial inquiry of the secret activities of the State (reserved funds, responsibility of officials, etc.). The conclusion is that justice always has the power to investigate all crimes, but the judges are not competent to reveal legally classified matters.
