Abstract
A partir de la Ley de Conciliación Vida Familiar y Laboral
de 1999, en España se va construyendo un marco
jurídico importante. Aparecen nuevas normas y prestaciones
para conciliar vida laboral y familiar. La incorporación
de la mujer al mundo laboral y productivo,
sin abandonar el espacio reproductivo y familiar, ha
llevado a los estados de bienestar europeos a legislar
sobre conciliación para dinamizar y flexibilizar ambos
espacios. Este estudio tiene como objetivo describir
cronológicamente el marco jurídico construido en
España desde 1999 (Ley de Conciliación) hasta 2009,
dos años después de la entrada en vigor de la Ley de
Igualdad. Para ello, y a partir de una revisión bibliográfica,
se hará un análisis recopilatorio de las normas
sobre conciliación en el plano internacional, en Europa
y finalmente en España para compatibilizar el ámbito
familiar con el laboral. En España, en concreto, se
realiza un análisis de las dos normas más importantes
sobre este tema: Ley 39/1999, de 5 de noviembre,
para promover la Conciliación de la Vida Familiar y
Laboral de las Personas Trabajadoras y Ley Orgánica
3/2007, de 22 de marzo, para la Igualdad Efectiva de
Mujeres y Hombres. El objetivo es describir la situación
jurídica del problema y analizar las medidas propuestas
para su solución
Since the Reconciliation of Work and Family Life Act passed in Spain in an important legal framework is being developed for Life-Work Balance. . The incorporation of women into the labor market without abandoning the reproductive and family space, has led the European welfare states to legislate on conciliation to energize and relax both spaces. This study aims to describe chronologically the legal framework built in Spain since 1999 (Reconciliation Act) until 2009, two years after the enforcement of the Equality Act. Together with a review of existing literature on this subject, an analysis was made of a compilation of international the rules on life-work balance; in Europe and finally in Spain. In Spain, in particular, an analysis was made of the two most important rules on this subject: Law 39/1999, November 5, to Promote the Reconciliation of Work and Family Life of Employed Persons, and Organic Law 3/2007, March 22, for Effective Equality Between Women and Men. The aim is to describe the legal status of the problem and to analyze the measures proposed for its solution.
