Abstract
Regulado nuevamente el matrimonio en el Concilio de Trento y ratificada su indisolubilidad, es evidente
que la realidad conyugal no siempre marcharía por los caminos propuestos. Abordamos aquí el matrimonio
como espacio de conflictos en donde las desavenencias y los problemas de convivencia (incluida
la violencia o la infidelidad) propiciaron la solicitud de separación o divorcio (temporal o perpetuo), de
demandas de nulidad eclesiástica y, en dirección contraria, de petición de “vida maridable”. Analizamos
tales pleitos y causas en un espacio -Arzobispado de Sevilla- a lo largo del Siglo XVIII, sin olvidar ni el
contexto histórico, ni las posibilidades brindadas por el derecho canónico.
Despite new marriage regulations of the Council of Trent and the ratification of the indissolubility of the institution, conjugal realities clearly didn’t always follow proposed paths. In this article we approach matrimony as a locus of conflicts in which disagreements and problems of conviviality (including violence or infidelity) propitiated requests for separation or divorce (temporary or perpetual), ecclesiastical annulment and, contrarily as well, petitions for marital life. We analyze these lawsuits and trials within the context of the Archbishopric of Seville throughout the 18th century, without disregarding the historical context nor the possibilities afforded by Canon Law.
