The Legal Fiction of Non-Entry under the New Pact on Migration and Asylum: Reflections on the Danané and Others Judgment

Abstract

This paper examines the legal fiction of non-entry within the framework of the New Pact on Migration and Asylum, with particular attention to the judgment of the Court of Justice of the European Union in Danané and Others (Joined Cases C-50/24 to C-56/24). The analysis explores how the progressive functionalisation of borders within the Common European Asylum System has transformed the traditional territorial conception of the border into a differentiated legal regime based on screening procedures, border procedures and mechanisms of early classification. Against this background, the paper assesses the implications of Danané and Others for the development of a functional conception of the border and for the operation of the legal fiction of non-entry under EU asylum law. It argues that, although the judgment confirms the possibility of maintaining applicants under a border regime despite their physical presence within the territory of a Member State, it simultaneously reaffirms that effective control over the individual continues to trigger obligations derived from fundamental rights. Particular attention is paid to the role of effective control, non-refoulement and access to international protection as material limits to the operation of territorial fictions in contemporary European migration governance.

Este artículo examina la ficción jurídica de la no entrada en el marco del Nuevo Pacto sobre Migración y Asilo, con especial atención a la sentencia del Tribunal de Justicia de la Unión Europea en el asunto Danané y otros (asuntos acumulados C-50/24 a C-56/24). El análisis explora cómo la progresiva funcionalización de las fronteras dentro del Sistema Europeo Común de Asilo ha transformado la concepción territorial tradicional de la frontera en un régimen jurídico diferenciado basado en procedimientos de control, procedimientos fronterizos y mecanismos de clasificación temprana. En este contexto, el artículo evalúa las implicaciones del asunto Danané y otros para el desarrollo de una concepción funcional de la frontera y para el funcionamiento de la ficción jurídica de la no entrada en el derecho de asilo de la UE. Sostiene que, si bien la sentencia confirma la posibilidad de mantener a los solicitantes bajo un régimen fronterizo a pesar de su presencia física en el territorio de un Estado miembro, reafirma simultáneamente que el control efectivo sobre el individuo sigue generando obligaciones derivadas de los derechos fundamentales. Se presta especial atención al papel del control efectivo, la no devolución y el acceso a la protección internacional como límites materiales al funcionamiento de las ficciones territoriales en la gobernanza migratoria europea contemporánea.
