Réplica del Derecho Penal del Enemigo. Sobre seres humanos, individuos y personas del derecho

Abstract

El autor se opone a la introducción de un nuevo concepto en el sistema criminal de justicia: un Derecho Penal contra el enemigo, concepto recientemente desarrollado por Jakobs. Según expone Jakobs, la sociedad es comunicación personal regida por normas, y es ésta (sus líderes) la que decide quiénes serán miembros de la sociedad y quiénes quedarán excluidos de la misma. Por otro lado, diferencia entre «individuos» y «personas», siendo estas últimas quienes adquieren el estatuto de persona, esto es, aquellos sujetos que ofrecen una garantía cognitiva de respeto al conjunto de normas de una sociedad. De este modo, la persona está definida por el rol que desempeña en la sociedad, como una construcción objetiva de la misma. Ante cualquier sujeto que no ofrece dicha garantía, el Derecho Penal cambia la reacción normal que tiene frente a los miembros de la sociedad, por una reacción contra el enemigo, como si fueran animales salvajes. En definitiva, se trataría de eliminar al enemigo o de aceptarlo como tal, criterio que estaría a discreción de la sociedad. El autor entiende que todo ser humano posee unos derechos fundamentales innatos de los que no puede ser despojado, sosteniendo, por tanto, que el concepto ofrecido por Jakobs es inhumano, al considerar a ciertas personas como animales salvajes sujetos al arbitrio de la sociedad de exterminarlos

The author opposes to the introduction of a new penal law concept into the criminal justice system: A penal law against so-called «enemies», a concept just recently developed by Jakobs. As Jakobs expounds, society is personal communication led by norms, and society (their leaders) decides who may be or become its member or be excluded from it. Jakobs carefully avoids regarding the members of society as human beings and differentiates between «individuals» and «persons under the law» (persons) instead. Only those may acquire the status of a person, who are oriented towards the norms of society and allow others to be geared towards those norms: A person must offer a cognitive guarantee to act as person and to observe the norms of society. Thus a person is defined by fulfilling its role assigned to her by society: it’s an «objective construction» by society. To anyone not offering a cognitive guarantee of the said kind, penal law changes from a reaction of society against an act of one of its members to a reaction against an enemy, like to protect society against wild animals: It’s a matter of discretion to either exterminate the enemy or to come to terms with him. To design human beings as objective constructions by society, as the author points out, means to refuse them any innate fundamental rights, never to be lost or revoked. Therefore, he considers Jakobs’s concept as inhumane and even so the demand for treating human beings as wild animals and to have them exterminated at society’s discretion
