Este artículo indaga la situación previa a la Constitución de Cádiz de 1812, sus bases filosóficas iluministas y su proyección en el derecho penal de la época, concretamente, su influencia en el Código Penal de 1822, en pleno “trienio liberal”, que constituye el nacimiento de la codificación penal en España.
This article investigates the situation leading up to the Cádiz Constitution of 1812, its Enlightenment philosophical foundations and its impact in the Criminal Law of the time, specifically its influence on the Penal Code of 1822, during the “Liberal Triennium”, which marks the birth of criminal codification in Spain.
