Abstract
El artículo analiza críticamente, desde la perspectiva del principio de culpabilidad, la regulación de la
intoxicación plena voluntaria en el derecho penal chileno. La crítica se dirige luego a las alternativas de tratamiento
que se consideran legítimas en el derecho comparado, en particular aquéllas que se construyen en torno a la doctrina
de la actio libera in causa. A juicio del autor, la única variable de dicha doctrina, compatible con el principio de culpabilidad
por el hecho, es el llamado «modelo del tipo», el que, sin embargo, tiene alcances operativos mucho más
limitados que los que le suele reconocer una práctica que en realidad encubre una represión que no respeta los criterios
reconocidos de imputación objetiva y que, en último término, castiga por el pensamiento. Por último, se analizan
las posibilidades de una regulación penal autónoma de la autointoxicación, tanto para la obtención de mejores resultados
prácticos como para el efectivo respeto de los límites constitucionales del derecho penal
The article critically analyzes the regulation of the full voluntary intoxication in the Chilean criminal law from the perspective of the mens rea requirement. The criticism then goes to the alternatives of treatment that are considered to be legitimate in other countries, in particular those that are constructed concerning the actio libera in causa theory. According to the author, the only compatible variable of that doctrine with the mens rea requirement is the «offence definition model», which, nevertheless, has much more limited operative scopes than those that usually recognises a practice that in fact conceals a repression that does not respect the recognised criteria of causation («objective ascription») and that, at the end, punishes for the thought. Finally, the possibilities of a penal autonomous regulation of the voluntary intoxication are analysed, both for the improvement of practical results and for the effective respect of the constitutional limits on criminal law
