Abstract
El presente trabajo pretende analizar cómo pierde vigencia un convenio colectivo en España. Se trata de un tema complejo, pues hay elementos contradictorios que entran en juego: de un lado el carácter temporal del convenio, pero también la libertad de las partes para regular la cuestión y, por último, el papel de la propia regulación legal que establece mecanismos dirigidos a dotar al convenio de cierta estabilidad para evitar vacíos normativos. Por otra parte, la jurisprudencia tiene también un papel relevante, especialmente para resolver aquellas situaciones en las que la prórroga del convenio colectivo tiene carácter indefinido, pues ha permitido evitar la petrificación de las condiciones pactadas en convenio. Como comprobaremos, este conjunto de elementos contradictorios dificulta determinar con precisión el momento de pérdida de vigencia del convenio.
This work aims to analyze how a collective agreement loses validity in Spain. This is a complex issue, as there are contradictory elements that come into play: on the one hand, the temporary nature of the agreement, but also the freedom of the parties to regulate the issue and, finally, the role of the legal regulation itself that establishes mechanisms aimed at providing the agreement with a certain stability to avoid regulatory gaps. On the other hand, jurisprudence also has a relevant role, especially to resolve those situations in which the extension of the collective agreement is indefinite, since it has made it possible to avoid the petrification of the conditions agreed in the agreement. As we will see, this set of contradictory elements makes it difficult to determine precisely the moment of loss of validity of the agreement.
